Terms and Conditions
The terms and conditions are set out below. Gemma values providing a personal service and understands what an important purchase your artwork will be. If you have any queries about purchasing an art work, or are unsure how the terms and conditions may apply to your order, please don’t hesitate to contact Gemma.
Artwork by Gemma Hermans is available to purchase from her atelier, online or from any of her exhibitions.
Delivery and shipping
Delivery is usually by PostNL within the Netherlands and for international shipping orders. Your order is usually dispatched within 1-3 working days. But it may take up to 1 weeks to arrive at your address. International shippings may take longer (1-2 weeks for overseas). Note that international customs charges are the buyer’s responsibility.
If you see any damage when your package is being delivered, you can either refuse the shipment as [damaged – return to sender] or you can have the delivery company mark the tracking as [received damaged, subject to further inspection]. Please file the claim immediately. You also must keep all boxes and packing material. When you call you will need the tracking number of your box, a description of the damage and its value. Take pictures of the damaged package and send them to Gemma as detailed as possible.
If you would like to have the artwork within a specific time please contact Gemma for options. A priority surcharge may be applied.
Commissioning an artwork
On receipt of a commission you will be provided with a specification, an approximate timescale for delivery and a price, which will include a price for delivery. Please note that all artworks must be paid for in € (EUR) therefore the price for a commission may change due to fluctuations in exchange rates if you are completing the transaction in another currency. Additional bank costs are for the client.
A payment in advance is required for all commissions which is non-refundable. Work is not started on any artwork before the payment is received. On paying you are entering into a contract with the artist for the provision of an artwork, agreeing to the specification provided by Gemma Hermans, and to pay the total price quoted at a date to be agreed. You are also agreeing to these terms and conditions.
Once the payment is received, a charge may be applicable to change the specification of your artwork. While Gemma Hermans will always try and incorporated changes required by the customer, they may not always be possible once work on a piece has started.
Returns and cancellations – commissioned items
Under your contract with Gemma Hermans the supply of goods (your artwork) is made specifically to meet your specifications and therefore your order cannot be cancelled after it has been ordered. In the highly unlikely event your commission does not match your specification. Gemma Hermans will endeavor to resolve the situation to your satisfaction as quickly as possible. Please contact her to explain your specific queries and agree a course of action.
Returns and cancellations
We do not accept items purchased from Gemma Hermans to be refunded or returned. Therefore all sales are final, except in the case of damage. We’d like all information, photographs and shipping information to be as accurate as possible. If your artwork has been damaged, if able, make the courier aware upon receipt. Of course we hope this never happens but contact Gemma as soon as possible and we will help you as best as we can. We value our customers so don’t hesitate, we will do our best to rectify any issues.
